We operate the province’s electricity grid 24/7, design, run and oversee the wholesale electricity markets, and plan and prepare to meet Ontario’s electricity needs – now and into the future.The opportunityThis position reports to the Senior Manager, Rule Enforcement and oversees the MACD unit which performs the core functions which serve to support the enforcement of various provisions of the Ontario electricity market rules which permit the IESO to recover or clawback certain market payments. This function complements MACD’s compliance-enabling functions.These functions include variously termed processes such as audits, reviews, investigations (among other terms) under the market rules, depending on the specific rule. Although these matters may lead to dispute, litigation and appeal under the market rules, they do not involve the imposition of financial penalties and other sanctions. They involve the determination and execution of recovery and clawback powers afforded the IESO under the Market Rules.This position supervises and coordinates all operational processes related to this investigation function, as well as the development, maintenance and adherence to an operational framework governing those processes.What you’ll doEnforcement DisputesIn coordination with other MACD managers and supervisors, and IESO Legal Services, as required, as required, supervises and coordinates execution of procedures, steps and decisions in the IESO’s dispute resolution process, as it pertains to disputes arising specifically from MACD recovery and clawback determinations and orders. This includes supervising and coordinating teams, staff and contractors in respect of good faith negotiations, mediation, arbitration, and/or appeal hearings before the Ontario Energy Board or the provincial courts, including the presentation of evidence and other information related to MACD audits, investigations, reviews and other processes which have led to such enforcement determinations.Audits and payment recoveriesSupervises and coordinates teams, contractors or staff in the execution of delegated authorities of the IESO pursuant to the market rules, including the execution of audits, investigations, reviews or other processes, which may lead to clawbacks and recoveries of settlement amounts.These authorities, at a minimum, include the execution of provisions of the market rules related to: Generation Cost Guarantees, Local Market Power, a variety of Congestion Management Settlement Credit circumstances, Intertie Transaction Failures, Transmission Rights Payments, and Operating Reserve payments, and the making of recommendations as to clawbacks or recoveries of related settlement amounts and/or, as delegated, make determinations in relation to such recoveries or clawbacks.In coordination with other MACD managers and supervisors, and IESO Legal Services, as required, supervises and coordinates execution of procedures and steps in the IESO’s dispute resolution process, as it pertains to disputes arising from recoveries, clawbacks, or other such matters arising from these IESO authorities.Liaises, where applicable, with other government agencies, IESO business units and Legal Services pursuant to various MOUs and protocols.Vets findings and recommendations to support Director of MACD’s consideration of relevant enforcement rulings, determinations and orders.Ensures the MACD business unit’s adherence with all market rules and administrative law principles governing such audit, investigation, review and other relevant processes, to provide assurance in respect of IESO and MACD reputational and litigation risk in the event of downstream dispute and litigation of MACD enforcement rulings.Intra-IESO coordinationIn coordination with Supervisor, Market Monitoring and Analytics, supervises and coordinates teams, staff and contractors in respect of mandated market monitoring, complaint intake, whistleblower referrals and other detection methods, for the purpose of identifying settlement amounts relevant to the audit, investigative, review and other processes which may lead to clawbacks and recoveries.Supervises and coordinates the effective monitoring or other detection methods with other business units of the IESO who are also engaged in activities which involve gathering of market or participant information and/or who also make use of this monitoring for their business purposes.Supervises and ensures the effective coordination of these manual and analytical processes with the automated clawback and recovery provisions carried out by the IESO’s Settlements business unit.Permissive Provision Enforcement FrameworkSupervises and coordinates teams, staff and contractors in the development of, maintenance of and adherence to a framework governing all of the above processes, including policies, handbooks, guides, procedures, processes, templates, tools and manuals.Market leadershipProvide advice to the government, regulator, and/or other stakeholders on marketplace environmental considerations, as required.Supervises and coordinates the development and execution of plans and works with stakeholders and government to develop greater clarity and effectiveness concerning market and compliance issues, as required.OtherEnsure that the confidentiality of data from/about market participants is safeguarded during the process of the relevant audits, investigations, reviews, and other processes;Perform other duties as assigned.What you need to succeedEducation:Requires academic training in Law, Engineering, Economic or Business or related degree to understand the legislation, policies, procedures, rules and standards governing the Marketplace including those that define the market rules in a market, economics and technical setting.Excellent command of the English language, in order to ensure a high quality of customer service in the area of rule enforcement and interpretation, that performance standards are clearly defined and high quality in the design/delivery of appropriate training.This knowledge is considered to be normally acquired through the successful completion of a university degree in Accounting, Auditing, Law, Engineering, Business, or a related discipline.Experience:Extensive knowledge of the Market Rules governing the Ontario electricity marketplace, perhaps acquired through work with the Market Rules group of the IESO, the Market Design Committee, the Market Assessment and Compliance Division or the IESO’s Technical Panel.Experience in audit and investigation procedures and techniques, case management, litigation and evidence procedures and processes.Experience in power system planning and operation, electric and/or other utility or financial environment, with focus on such areas as planning, contract administration, operations, regulatory and/or enforcement activities.Experience in developing and managing detailed business processes; supervising staff; in strategically evolving a new business; and identifying and implementing efficiency and effectiveness improvements.
