Job Title: Legal Counsel, Regulatory and Health LawWork Site: Exec - 601 W. Broadway, 11 flrStatus:Start Date:Hours:Regular Full TimeAs soon as possible0900-1700Days off: Saturday, Sunday, Statutory HolidaysReference#: 159436-cmcCome work as a Legal Counsel, Regulatory and Health Law with Vancouver Coastal Health (VCH)!Reporting to the Senior Legal Counsel, Regulatory and Health Law (Senior Legal Counsel), the Legal Counsel, Regulatory and Health Law (Legal Counsel) possesses the strong leadership abilities required to provide a broad range of legal support and advice to leaders and staff across all levels at Vancouver Coastal Health (VCH). The Legal Counsel anticipates and identifies legal issues, and is able to work independently to advise decision-makers and other internal stakeholders on legal strategies and solutions to mitigate legal risk. The Legal Counsel will work closely with the Senior Legal Counsel as part of an in-house legal team to support VCH leaders, managers, and staff, with a particular focus on general health law, mental health law, adult guardianship, public health, and health care consent and decision-making.As a Legal Counsel, Regulatory and Health Law with Vancouver Coastal Health you will:

  • Interpret legal framework applicable to public healthcare sector and advise on impact to the organization, programs, services and staff, with a particular focus on general health law, mental health law, adult guardianship, public health and health care consent and decision making.
  • Provide legal advice and opinions to VCH senior leadership, managers, staff as well as other members of the Legal Services team to enable effective and patient-centered decision-making.
  • Work closely with a diverse set of professionals including professional practice leaders, public health leaders, mental health, health protection and adult protection leaders, risk management and human resources Directors, physician leaders, and other clinical and corporate functions, to provide legal advice on various VCH clinical projects and initiatives.
  • Manage clinical context litigation and health law related administrative tribunal matters as assigned, and liaise with client leaders, external counsel, and legal counsel in other public bodies, as required. (Note: the Legal Counsel would rarely appear to represent VCH in a court proceeding. The Legal Counsel’s focus is to liase with client leaders and to manage and instruct external legal counsel in matters proceeding before a court / administrative tribunal.)
  • Anticipate and identify legal issues and advise decision-makers and other internal stakeholders on legal strategies and solutions to mitigate legal risk.
  • Assess and make recommendations on health law related policies, procedures and practices.
  • Attend regularly scheduled clinically focused Committee meetings as assigned, to learn the issues facing the stakeholders, and to provide legal advice to the accountable VCH leaders, and reports to the Senior Legal Counsel, as directed.
  • Maintain professional growth and development through seminars, workshops, and professional affiliations to keep up-to-date with new/revised legislation, developing case law, and relevant health care trends.
  • Perform other job related duties.
QUALIFICATIONS:Education & Experience
  • Law Degree from a recognized University supplemented by a minimum of seven (7) years of recent, related experience practicing law, preferably with a public sector organization or a firm providing legal services to a public sector organization.
  • Health care experience or health law advising experience is preferred
  • A minimum of five (5) years of recent related experience as counsel or co-counsel representing clients before administrative tribunals or the courts in British Columbia.
  • A member in good standing with the Law Society of British Columbia (or eligible for membership within a specified period).
Knowledge & Abilities
  • Demonstrated understanding of and familiarity with the legal framework governing public sector organizations.
  • Familiarity with and/or ability to understand complex healthcare system.
  • Ability to work independently to provide timely and practical legal advice and guidance to internal stakeholders and decision-makers
  • Strong knowledge of administrative law
  • Knowledge of general health law preferred
  • Strong ability to foster and maintain positive relationships with various internal and external stakeholders
  • Ability to provide timely and practical legal advice and guidance to internal stakeholders and decision-makers.
  • Advanced drafting skills and experience in reviewing, drafting and negotiating a wide range of legal documents
  • Advanced expertise in assessing and making recommendations on policies, procedures and practices.
  • Strong skills in drafting pleadings, affidavits, and related documents for matters proceeding before courts or administrative tribunals.
  • Ability to develop and bring forward solutions and communicate effectively (both verbally and in writing) with a wide variety of audiences.
  • Exemplary interpersonal, communication and problem-solving skills.
  • Strong ability to multitask effectively.
  • Models personal integrity and accountability, and is a committed team player.
