Job Description

LOCATION: 14 Carlton StreetWORK ILLUSTRATION:Responsible for the negotiation, production of documentation, drafting easements and the coordination of information pertaining to all property related inquiries and registrations. They report to the Manager, Business Law Services but works independently and acts as the sole real property technical expert to both internal departments, external customers including, property owners and their counsel on behalf of Toronto Hydro.The incumbent is expected to behave ethically and follow the established code of business conduct, policies and internal control procedures, laws and regulations governing Toronto Hydro.Toronto Hydro has implemented a mandatory vaccination requirement for all its employees. Proof of full vaccination will be required upon receiving a conditional offer of employment. Toronto Hydro will provide reasonable accommodation to individuals who cannot be vaccinated due to disability or any other ground protected by the Ontario Human Rights Code.KEY RESPONSIBILITIES:

  • Property related inquires: Acts as the single point of contact and independently handles a high volume of inquiries from business units and advises on real property matters (rights to access, occupy and work on property) involving Toronto Hydro; responsible for negotiation with third party property owners (e.g. developers, customers etc) to secure property rights (e.g. Easements, leases and licenses) on behalf of Toronto Hydro in support of construction projects, including capital projects, connections, major projects, street lighting, transit related projects and external relocation projects,) Independently prepares all first drafts of easements and offers to connect, etc. for review by counsel (internal/external).
  • Analysis and interpretation: Accurately works with and routinely responds to internal and external stakeholders with regard to easement related inquiries (both registered and unregistered, the latter can only be searched through our internal database) for previously completed work and current capital projects, connections, etc. ; responsibility involves the analysis and interpretation of electronic records, drawings, agreements and correspondence to determine the interest that Toronto Hydro has in such property in compliance with our legislative requirements. Receives, reviews and responds to unregistered easement requests for Toronto Hydro.
  • Legal advisement: Advises and consults with business units on general legal requirements, relevant laws and regulations as they relate to real property to assist with daily operations and proactively address compliance issues, and deals with any issues that arise as they pertain to real property (The Electricity Act and The City of Toronto Act).
  • Title Searches:Conducts title searches (via Teraview) and document registration to review and confirm title related matters concerning properties to validate that Toronto Hydro’s rights are properly understood/enforced with respect to existing installations and properly protected in relation to any new installations for capital projects, relocations or offers to connect. Reviews and engages with various business units to understand whether there is a real property right that needs to be protected.
  • Document Management: Acts as the custodian of all real property records and the document management database on behalf of the Business Law team to validate current records properly reflect the interest of Toronto Hydro and supports all property related transactions (e.g. property sales and acquisitions). Works closely with Toronto Hydro’s facilities department (the custodian of all real property records on behalf of the company) to validate and align all real property documentation and land rights are properly tracked.
REQUIREMENTS:
  • Law Clerk diploma or University degree in Legal Studies or a related field.
  • Institute of Law Clerks of Ontario designation with a focus on Real Property.
  • Five (5) years of experience in Real Estate Law or Real Property (preferred).
  • Previous experience with Teraview and other related document management tools (e.g. OpenText)
  • Experience processing easements or related legal documents.
  • Highly proficient in the use of Microsoft office software (Word, Excel, PowerPoint) and Teraview (software to access Government of Ontario’s land records database).
  • Experience in the review and analysis of legal title documentation, reference plans, drawings, plans of subdivision and surveys to ensure Toronto Hydro’s property interests are maintained.
  • Experience in processing of easements or related legal documents.
  • Familiarity with Real Property terminology and procedures.
  • Experience in providing support to Business Units in regard to in Real Property matters.
  • Experience in a utility environment (preferred).
  • Experience in negotiating easements.
  • Familiarity with viewing of and interpretation from utility plant records in manual and electronic format.
  • Highly motivated, with willingness to grow.
  • Sound judgment and problem-solving skills, with the ability to respond to multiple demands, prioritize work activities and manage expectations in a fast paced environment.

Toronto Hydro has introduced a Hybrid Work Arrangement. This position allows for remote work up to three days per week, based on business needs. Employees will be required to come onsite on those days when they are involved in activities that they or their leader feel are better conducted in person.
